Users are hereby specially reminded to read and fully understand this agreement carefully (especially the content marked with bold and underline):
In this “User Registration Agreement,” “User” refers to an individual or enterprise that intends to download, install, or useHabibi Speedand other software services operated by Najm AlTiknolojia Ltd. Company (hereinafter referred to as Najm AlTiknolojia) and its affiliated companies, and applies to register as a Najm AlTiknolojia user.
The User’s agreement to these registration terms is considered a reading and acceptance of this Agreement, and is understood as the User agreeing to be bound by all terms of this Agreement, which is legally binding on the User.
These registration terms become effective when the User checks the agreement box on the registration page.
Article 1Habibi SpeedService Introduction and Applicability of This Agreement
1-1Habibi Speed(hereinafter also referred to as “the Software” or “HabibiSpeed”) provides network accelerator services to its member users.
1-2 The User’s acts of downloading, installing, using, obtaining an account, and logging in shall be deemed as reading and accepting this Agreement, and shall be understood as the User agreeing to be bound by all terms of this Agreement.
1-3 The content of this Agreement, the “Privacy Policy” published by Najm AlTiknolojia (detailed in the appendix of this Agreement or any future updated policy that may be published), and the various rules that Najm AlTiknolojia has published or may publish/update in the future, form an inseparable whole and have equal legal effect. This Agreement may be updated by Najm AlTiknolojia at any time with notice to the User. If the User does not accept the updated terms after Najm AlTiknolojia updates this Agreement, the User must immediately stop using the Software and accepting related services provided by Najm AlTiknolojia. Continued use of the Software and acceptance of related services provided by Najm AlTiknolojia will be deemed as acceptance of the updated terms of this Agreement.Article 2 User Guarantees
2-1 The User promises and guarantees that they are a natural person, legal entity, entity, or organization with full capacity for civil conduct and full civil rights capacity. The User guarantees that the user information provided is true, accurate, complete, and timely, and contains no misleading or false statements, and guarantees that Najm AlTiknolojia can contact the User through the contact information provided. Persons with limited capacity for civil conduct should read this Agreement in the company of a statutory agent and obtain the statutory agent’s consent to the entire content of this Agreement, and all acts of accepting services and paying fees based on this Agreement. Persons without capacity for civil conduct shall not accept any services stipulated by this Agreement, unless legally represented by a statutory agent. Unless the User accepts all terms of this Agreement, the User has no right to download, install, or useHabibi Speedand its related services.
2-3 The User promises to promptly update their user information to maintain its validity.
2-4 If the materials or information provided by the User contain incorrect or untrue information, Najm AlTiknolojia reserves the right to cancel the User’s membership and terminate the provision of services to that User at any time.
2-5 Users who register as agents for other natural persons or entities must provide Najm AlTiknolojia with detailed information, materials, and a written authorization document for both the agent and the represented party. If the aforementioned information and documents are not provided to Najm AlTiknolojia, Najm AlTiknolojia will consider the registrant as the member.
2-6 The User fully understands that Najm AlTiknolojia will maintain contact and communication with registered users via email or mobile text message. The User hereby agrees to Najm AlTiknolojia sending routine information via email or mobile text message.Article 3 Intellectual Property Statement
3-1 This Software is provided by Najm AlTiknolojia. All copyrights, trademark rights, patent rights, trade secrets, and other intellectual property rights of this Software, as well as all information content related to the software, including but not limited to: text descriptions and their combinations, icons, decorations, charts, colors, interface design, layout, relevant data, printed materials, or electronic documents, are protected by local copyright law, trademark law, patent law, anti-unfair competition law, relevant international treaties, and other intellectual property laws and regulations. Except for software or technology involving third-party authorization, Najm AlTiknolojia enjoys the aforementioned intellectual property rights.
3-2 Without the prior express consent of Najm AlTiknolojia, the User shall not, for any profitable or non-profitable purpose, independently implement, utilize, transfer, or license any third party to implement, utilize, or transfer the aforementioned intellectual property rights. Najm AlTiknolojia reserves the right to pursue legal liability for the aforementioned unauthorized acts.
3-3 Subject to compliance with this Agreement and the “Privacy Policy” published by Najm AlTiknolojia and the rules already published or that may be published/updated in the future, the User may install, use, display, and run one copy of the Software on a single terminal device. The User shall not copy, alter, modify, hook, run, or create any derivative works of the Software or the data released to the memory of any computer terminal during the Software’s operation, and the interactive data between the client and the server during the Software’s operation. This includes, but is not limited to, using plug-ins, add-ons not provided by Najm AlTiknolojia, or unauthorized third-party tools/services to access the Software and related systems.
3-4 Reserved Rights: All other rights not expressly authorized to the User in this Agreement still belong to Najm AlTiknolojia.
3-5 Content Ownership: The text, software, sounds, photos, videos, graphics in the Software and corresponding services, and all content in advertisements, are owned by Najm AlTiknolojia and related rights holders, and are protected by law. The User can only use this content with the authorization of Najm AlTiknolojia and shall not copy or use it in any other form without authorization.Article 4 User Notice
4-1 The User should properly safeguard their account and password, and is responsible for all activities and actions performed under that account. Gifting, lending, renting, transferring, or selling aHabibi Speedaccount is prohibited. Najm AlTiknolojia shall not be held liable for any loss resulting from the leakage of the User’sHabibi Speedaccount and/or password due to reasons not attributable to Najm AlTiknolojia, or due to improper custody, use, or maintenance by the User.
4-2 To ensure theHabibi SpeedUser experience, Najm AlTiknolojia will strictly monitor inappropriate operations by Users that occupy bandwidth, including but not limited to abnormal traffic. If Najm AlTiknolojia monitors and identifies that the User’s account has the aforementioned inappropriate operation behavior, Najm AlTiknolojia has the right to choose to temporarily or permanently ban the violating account based on the severity of the behavior.
4-3 Any other software derived from this Software that is not authorized for development and formally released by Najm AlTiknolojia is illegal. Downloading, installing, or using such software may lead to unpredictable risks, and all resulting legal liabilities and disputes are irrelevant to Najm AlTiknolojia.
4-4 The User shall be fully responsible for the security of their username and password, and fully responsible for all activities and events performed under their username. The User has the right to modify the password according to the procedures specified by HabibiSpeed.
4-5 The username and password shall not be transferred or authorized for use by others without the written consent of HabibiSpeed, otherwise the User shall bear all resulting consequences.
4-6 If the User discovers any illegal use of the user account or a security vulnerability, they should immediately notify Najm AlTiknolojia via the customer service hotline.Article 5 Modification of Service Terms and Service System Revision
Najm AlTiknolojia has the right to modify the service terms when necessary. Once the Najm AlTiknolojia service terms change, the changes will be prompted on important pages. If the User does not agree with the modified content, they can voluntarily cancel the network service. If the User continues to enjoy theHabibi Speednetwork service, they are deemed to accept the change in service terms. Najm AlTiknolojia reserves the right to modify its service system and prices at any time without notifying the User. If the User and Najm AlTiknolojia have reached an agreement on specific services and the User has paid the agreed-upon fees before Najm AlTiknolojia modifies its service and price system, Najm AlTiknolojia will execute the agreement until the expiration of the service period for which fees have been paid.Article 6 User Rights and Obligations
6-1 The User has the right to possess theirHabibi Speedusername and password and has the right to use their username and password to log in to the member exclusive area of theHabibi Speedwebsite at any time.
6-2 Please properly safeguard your account password and do not share it with others. Multiple people online with the same account will affect your normal use. The User shall bear any account losses caused by privately disclosing the password to others.
6-3 The User has the right to enjoy the Internet technology and information services provided by HabibiSpeed, and has the right to obtain technical support and consultation services fromHabibi Speedwhen accepting the services provided by HabibiSpeed. Details of the service content can be found in the relevant product introduction.
6-4 The User guarantees that they will not use technology or other means to damage or disrupt theHabibi Speedwebsite and the websites of other cooperative clients.
6-5 The User should respect the intellectual property rights and other legitimate rights of Najm AlTiknolojia and other third parties. The User guarantees that they will do their best to protect Najm AlTiknolojia, its employees, partners, etc., from being affected or incurring losses due to the aforementioned events. Najm AlTiknolojia reserves the right to terminate the service, not refund any fees, and pursue compensation if the User infringes upon HabibiSpeed’s intellectual property rights.
6-6 The User shall be solely responsible for all consequences arising from incorrect contact information provided to Najm AlTiknolojia and/or poor security or stability of the email address used by the User to receive Najm AlTiknolojia emails. This includes, but is not limited to, consequences and losses caused by the User’s failure to receive relevant notices fromHabibi Speedin time.
6-7 Normal use of the game acceleration service provided by Najm AlTiknolojia will not lead to a game account ban. Najm AlTiknolojia shall not be held liable for account bans and losses caused by the User’s own actions that violate game service guidelines (e.g., using third-party software in the game, including but not limited to cheats, scripts, auxiliary software) and losses caused by frequent IP changes due to the use of other accelerators.
6-8 The User guarantees that their use ofHabibi Speedservices will comply with national and local laws, regulations, industry practices, and social public morals. The User will not use the services provided byHabibi Speedto store, publish, or disseminate the following information and content:Any content (information) that violates national laws, regulations, and policies;
Political propaganda and/or news information that violates national regulations;
Information involving state secrets and/or security;
Feudal superstition and/or obscene, pornographic information, or information that incites crime;
Gambling with prizes, gambling games;
Information that violates national ethnic and religious policies;
Information that hinders the safe operation of the Internet;
Information that infringes upon the legitimate rights and interests of others and/or other information or content detrimental to social order, public security, or public morals.
The User also promises not to provide any convenience to others for publishing the aforementioned information content that does not comply with national regulations and/or the stipulations of this Service Agreement, including but not limited to setting up URLs or banner links. The User acknowledges that Najm AlTiknolojia has the right to terminate the provision of services and not refund any fees if the User violates the above stipulations. If the User’s aforementioned acts cause losses to HabibiSpeed, the User shall compensate for such losses.
6-9 The User may use the Software in accordance with this Agreement, provided they comply with laws and this Agreement. The User has no right to engage in the following acts, including but not limited to:(1) Logging in or using Najm AlTiknolojia software and services through unauthorized third-party compatible software or systems developed, authorized, or recognized by Najm AlTiknolojia, or using unauthorized plug-ins developed, authorized, or certified by Najm AlTiknolojia for Najm AlTiknolojia’s software and services;
(2) Deleting any copyright information or content on the Software and other copies;
(3) Reverse engineering, reverse assembly, reverse compilation of the Software, etc.;
(4) Unauthorized actions regarding the Software’s related information, without the prior express consent of Najm AlTiknolojia, including but not limited to: use, lease, lending, copying, modification, linking, reprinting, compiling, publishing, setting up mirror sites, or unauthorized leveraging of the Software to develop related derivative products, works, services, plug-ins, add-ons, compatibility, interconnection, etc.;
(5) Engaging in any acts that endanger computer network security, including but not limited to: using unauthorized data or accessing unauthorized servers/accounts; entering public computer networks or other people’s computer systems without permission and deleting, modifying, or adding stored information; implementing or attempting to implement probing, scanning, testing the weaknesses of the Software system or network, or other acts that may destroy network security without permission; implementing or attempting to implement interference with or disruption of the normal operation of the Software system or website, disseminating malicious programs or viruses, and other acts that may destroy or interfere with normal network information services; forging TCP/IP data packet names or parts of names;
(6) Using the Software and other services provided by Najm AlTiknolojia in any other illegal way, for any illegal purpose, or in any way inconsistent with this Agreement.
If the User violates the above stipulations, Najm AlTiknolojia has the right to take measures including but not limited to termination, complete or partial suspension, or complete or partial restriction of the Software’s usage functions.
6-10 The User shall bear full responsibility for all liabilities arising from the User’s illegal use or use that violates the stipulations of this Agreement, and it is entirely unrelated to Najm AlTiknolojia and its partners. If this causes losses to Najm AlTiknolojia and its affiliated companies or partners, the User shall compensate for such losses. At the same time, Najm AlTiknolojia has the right to take measures including but not limited to interrupting the use license, ceasing to provide services, restricting use, deleting the User account, and pursuing legal liability without prior notice to the User, depending on the nature of the User’s behavior.Article 7 Rights and Obligations of HabibiSpeed
7-1 Najm AlTiknolojia should provide qualified network technology and information services to the User based on the services selected by the User and the payment made.
7-2 Najm AlTiknolojia commits to taking external confidentiality measures for User data, not disclosing User data to third parties, and not authorizing third parties to use User data, unless:
(1) It can be provided according to the terms of this Agreement or other service agreements, contracts, or online terms between the User and Najm AlTiknolojia;
(2) It should be provided according to the provisions of laws and regulations;
(3) Administrative, judicial, or other competent authorities requireHabibi Speedto provide it;
(4) The User agrees toHabibi Speedproviding it to a third party;
(5) It is submitted by Najm AlTiknolojia to resolve a reporting incident or initiate a lawsuit;
(6) It is necessary for Najm AlTiknolojia to take necessary and reasonable actions to prevent serious illegal acts or suspected criminal acts from occurring;
(7) It is provided by Najm AlTiknolojia to a third party to provide products, services, or information to the User, including situations where Najm AlTiknolojia provides products, services, or information to the User through a third party’s technology and services.
7-3 Najm AlTiknolojia has the right to use User data under the rules of the “Privacy Policy”.
7-4 Najm AlTiknolojia reserves the right to terminate the provision of services and the User’s account in case the User violates national or local laws and regulations or violates these online registration terms. In any case, Najm AlTiknolojia is not responsible for any indirect, accidental, special, and consequential damages.
7-5 Respecting the privacy of User’s personal information is a consistent system of Najm AlTiknolojia. Najm AlTiknolojia will take reasonable measures to protect the User’s personal privacy information. See the “Privacy Policy” in the appendix.Article 8 Installation, Use, Upgrade, and Termination of the Software
8-1 After the User carefully reads and accepts the terms of this Agreement and completes the corresponding installation procedure, they become the user of the Software. The User agrees and understands that they can only use the Software and the services related to the Software provided by Najm AlTiknolojia when they comply with all stipulations of this Agreement.
8-2 Najm AlTiknolojia reserves the right to provide the User with modified or upgraded versions of the Software at any time. After a new version of the software is released, Najm AlTiknolojia does not guarantee the continued availability of the old version of the software.
8-3 The User has the right to independently interrupt or terminate the use of the Software and uninstall the Software without prior notice to Najm AlTiknolojia. The User is aware that the functions of the Software and related services cannot be used after the Software is uninstalled.
8-4 Najm AlTiknolojia, with prior notice to the User, may modify the software functions, interrupt, or suspend related software services based on actual business needs. If Najm AlTiknolojia has provided prior notice to the User regarding such acts, the User agrees that Najm AlTiknolojia shall not be held liable to the User or any third party for any losses caused to the User by such acts.
8-5 The User has the right to apply to terminate their membership or one or more services they have applied for at Najm AlTiknolojia at any time, but the fees already paid shall not be refunded.
8-6 Najm AlTiknolojia has the right to decide to cancel one or more services provided to the User based on the actual situation, but should refund the remaining portion of the fees paid by the User for that service. Other than this, Najm AlTiknolojia shall not bear any responsibility.
8-7 After applying to become a Najm AlTiknolojia user, the User should comply with the resolutions made by Najm AlTiknolojia regarding anti-spam from time to time. The User promises not to use Najm AlTiknolojia’s services to engage in any act involving spam, including but not limited to the User using theHabibi Speedserver to send spam; the User’s spam containing relevant information about theHabibi Speedserver or IP address; the User’s websites containing content that supports spam services, such as selling email lists, email address search software, or bulk email software; the User’s spam containing their domain name registration information atHabibi Speedor other content or information that may lead domestic and international anti-spam organizations to believe thatHabibi SpeedorHabibi SpeedUsers are related to spam incidents. The User understands that once a spam incident occurs, it will cause huge and irreversible losses toHabibi Speedand all its Users. Therefore, if Najm AlTiknolojia finds that the User is involved in spam, it will immediately stop providing any services to that User, regardless of whether the services enjoyed by the User at Najm AlTiknolojia are charged or free, and regardless of whether the service is directly related to the act of sending spam. Najm AlTiknolojia has the right to cancel the User’sHabibi Speedmembership when the User is involved in a spam incident and reserves the right to claim compensation for losses caused to Najm AlTiknolojia by the User’s involvement in spam.Article 9 Dispute Resolution and Applicable Law
The conclusion, performance, interpretation, and resolution of disputes of this Agreement shall be governed by local laws and exclude the application of all other conflict of laws. If any dispute arises between the parties regarding the content or execution of this Agreement (including but not limited to contract disputes or other property rights disputes), the parties should resolve it through friendly negotiation. If the negotiation fails, the parties agree to submit the dispute to the People’s Court with jurisdiction at the place where this Agreement is signed for jurisdiction and handling.Article 10 Legal Liability and Force Majeure Clause
10-1 The User agrees to bear full compensation liability for any claims, demands, or losses asserted by any third party due to the User’s violation of this Agreement or other valid service terms, and to hold Najm AlTiknolojia and/or its affiliated companies and partners harmless from any compensation liability.
10-2 The User understands and agrees that the risks arising from voluntarily choosing to download or use the Software and all third-party software provided with or through the Software shall be borne by the User themselves. The User shall bear full responsibility for any damage to the computer system or loss of data caused by downloading or using the Software and such third-party software.
10-3 Najm AlTiknolojia shall not be held liable for losses caused by force majeure. Force majeure as referred to in this clause includes: natural disasters, changes in laws, regulations, or government orders, reasons specific to the nature of network services such as faults of domestic and foreign basic telecommunications operators, technical defects of computers or the Internet, limitations on Internet coverage, computer viruses, hacker attacks, etc., and other objective circumstances that are unpredictable, unavoidable, and insurmountable within the legal scope.Article 11 Supplementary Provisions
11-1 Najm AlTiknolojia and/or its affiliated companies and partners will provide the User with various Internet and mobile communication value-added services related to the Software, including free and charged value-added services, based on market and technological development. Najm AlTiknolojia and/or its affiliated companies and partners reserve the right to charge fees for relevant value-added services and change the charging standards and methods. If the relevant service is changed from free to charged, Najm AlTiknolojia and/or its affiliated companies and partners will notify the User in an appropriate form, and the User can voluntarily choose to accept or reject the charged service.
11-2 Najm AlTiknolojia has the right to place various advertisements and promotional information in or through the services. Any such promotional methods, including the transport of goods, payment, services, commercial terms, guarantees, and descriptions related to the advertisement, only occur between the corresponding User and the advertising seller. Najm AlTiknolojia shall not bear any responsibility and has no obligation to bear any part of the responsibility for such advertising sales.
11-3 If the User has any opinions or suggestions for improvement regarding the Software or the Software-related services, they can submit them to Najm AlTiknolojia. Please note that if you do so, you also grant Najm AlTiknolojia and third parties the right to use and incorporate your opinions or suggestions free of charge in the Software and other software provided by Najm AlTiknolojia.
11-4 If any term in these registration terms is deemed invalid by an authoritative institution, it shall not affect the validity of other terms, nor shall it affect the interpretation, liability for breach of contract, and effectiveness of the relevant stipulations for dispute resolution in this Service Agreement.
11-5 If a party changes its notice, communication address, or other contact information, it should timely notify the other party of the changed address and contact information from the date of change, otherwise the changing party shall bear all consequences resulting therefrom. The User agrees that the relevant notices of Najm AlTiknolojia shall be deemed served to the User simply by being published on the relevant webpage of Najm AlTiknolojia.
11-6 Due to reasons such as Najm AlTiknolojia being listed, acquired, merged with a third party, or changing its name, the User agrees that Najm AlTiknolojia can transfer its rights and/or obligations to the corresponding successor of HabibiSpeed’s rights/obligations.
11-7 Najm AlTiknolojia’s failure to exercise, timely exercise, or fully exercise the rights stipulated in this clause or enjoyed according to law shall not be deemed a waiver of that right, nor shall it affect Najm AlTiknolojia’s future exercise of that right.The User hereby reconfirms and guarantees that they have fully read and understood the above membership registration terms and voluntarily formally enter theHabibi Speedproduct and use the member online registration procedure, accepting the constraints of all the above terms.
